Steps for a Recall Election
All elected officials are subject to recall after holding office for at least six months. No recall petition shall be circulated or filed against any elected officer whose term of office will expire within six months.
- Submit petition format: The petition format must be approved prior to printing and circulating. Submit the petition format for approval (see chart below for more information). The format of the petition will be approved or rejected within 7 business days. The petition must contain a statement of 200 words or less stating the grounds on which the recall is sought. Within 3 business days of the petition form approval, the incumbent may submit a statement of no more than 300 words to be included on the petition. The statements may not contain profane or false statements.
- If approved: Circulate the petition.
- If disapproved: The Clerk & Recorder will provide specific reasons for the disapproval. The petition can be corrected and submitted again.

- Circulate the petition: Circulators have 60 days to gather signatures and submit petitions. Please review laws and rules before circulating your petition.
- It is recommended all circulators review the Petition Circulator Training module from the Secretary of State’s office.
- Submit petitions for determination of sufficiency: The Clerk & Recorder has 28 business days to review the petitions for sufficiency.
- Protest period: Any registered elector residing within the district may file a protest within 15 days after a petition is declared sufficient.
- Call for election: If the officer does not resign within five days after the sufficiency of the recall petition has been certified and the time for protest has passed, the designated election official shall call the election and set the election date between 30 and 60 days. If there is a general election within 120 days, the recall questions will be combined with that election.
